1.) Formation of the parking contract
The contracting parties are BD Parkraum GmbH and the customer, or a person instructed by the customer. By handing over the vehicle and the vehicle key, the customer declares their agreement to these terms and conditions.
The customer likewise accepts these terms and conditions when booking a parking space online or by telephone.
By parking a car, too, the customer undertakes to comply with these terms and conditions.
1a.) By concluding a contract with BD Parkraum GmbH, the applicant (customer) and BD Parkraum GmbH agree that, after handover, BD Parkraum GmbH will move the customer's vehicle to a suitable parking area for a fee and keep it there for the agreed period.
1b.) The application to conclude a contract with BD Parkraum GmbH may be submitted by the applicant by telephone, fax or email, or online by making a reservation. In the case of a written application, the contract is formed if it is not rejected vis-à-vis the applicant within 24 hours. In the case of a verbal agreement, the contract with BD Parkraum GmbH is formed when the vehicle and the vehicle key are handed over to BD Parkraum GmbH and the application form is signed.
2.) Payment
Payment falls due when the vehicle is collected and is to be made before the vehicle is handed back. The prices applicable at any given time are made known by publication on the internet and, on request, by sending a price list.
3.) Handover of the vehicle; handover report; items inside the vehicle
3a.) The customer must point out any special dimensions and characteristics of the vehicle (e.g. spoilers, side skirts, lowered suspension, unusual handling) as well as any particular susceptibility to damage (e.g. loose parts).
3b.) Liability where the vehicle key is not handed over
If the customer does not hand over the vehicle key, the vehicle will not be moved by BD Parkraum GmbH. The German road traffic regulations (Straßenverkehrsordnung) apply throughout the company premises.
Claims for damages by the customer for damage to the vehicle are excluded unless such damage is based on intentional or grossly negligent conduct on the part of BD Parkraum GmbH, its legal representatives or its vicarious agents.
Liability for damage arising from injury to life, body or health that is based on a negligent or intentional breach of duty remains unaffected.
BD Parkraum GmbH is entitled, but not obliged, to record existing pre-damage to the vehicle photographically for documentation purposes.
The customer is obliged to remove valuables and loose items from inside the vehicle. Liability for the loss of such items is governed by no. 7c of these terms and conditions.
3c.) Vehicle inspection and liability where the key is handed over
If the customer hands over the vehicle key, they are obliged to inspect the vehicle together with an employee of BD Parkraum GmbH before handover. Existing damage is to be documented completely and unambiguously in the handover report; this includes in particular written details and photographs, which become part of the report. The customer must arrive at the place of handover in good time so that a proper inspection is possible.
If the customer omits the inspection or refuses to allow it to be carried out, they bear sole responsibility for undocumented damage. In this case all claims for vehicle damage are excluded unless such damage is based on intentional or grossly negligent conduct on the part of BD Parkraum GmbH, its legal representatives or its vicarious agents.
Liability for damage arising from injury to life, body or health that is based on a negligent or intentional breach of duty by BD Parkraum GmbH or its vicarious agents remains unaffected.
3d.) The customer is liable for all soiling caused by oil or other loss of fluids from their vehicle.
4.) Parking period; consequences of exceeding the agreed parking time: €20 – €30 per extended day.
4a.) The maximum period for which the vehicle may be parked is three months. A longer period is to be agreed in writing in advance in individual cases. In such a case BD Parkraum GmbH is entitled to demand an advance payment in the amount of the period exceeding the three-month period.
4b.) If the vehicle is not collected within two weeks of the expiry of the parking period agreed in the application form, BD Parkraum GmbH is entitled to park the vehicle in a public, generally accessible car park or to have it towed away.
5.) Performance of the contract; non-performance
5a.) The customer is obliged to notify BD Parkraum GmbH of changes to the order, in particular changes to the travel dates, in good time, and at the latest one hour before the time provided for in the order form. If the changed data is not passed on to BD Parkraum GmbH in good time, BD Parkraum GmbH may demand from the customer compensation for the additional expense, in particular for making the vehicle available again, in accordance with the price list displayed at the time. In this respect, too, the customer is liable for errors made by an authorised person.

5b.) In the event of a withdrawal at least 24 hours before the time of handover, no cancellation costs are incurred. For this purpose the customer is asked to contact BD Parkraum GmbH by email or WhatsApp.
If the withdrawal takes place less than 24 hours beforehand, BD Parkraum GmbH is entitled to reasonable compensation, which includes a flat cancellation fee amounting to 50% of the agreed price.
5c.) Claims for damages, e.g. arising from flights that were not reached as well as from other missed appointments and from further costs incurred by the customer, are excluded.
6.) Withdrawal from the contract, withdrawal from a parking reservation.
BD Parkraum GmbH reserves the right, at its discretion in view of the order volume, to withdraw from the contract or from the parking reservation at any time in the event of overload, even after a successful booking.
BD Parkraum GmbH does not undertake to accept the contract on site after a booking or after an online payment; the parking reservation may be withdrawn or refused at any time.
7.) Shuttle transfer and special features
7a.) Shuttle times and night surcharge
The shuttle transfer is free of charge daily between 03:00 and 00:00.
For shuttle journeys between 00:00 and 03:00 a night surcharge of €35.00 per transfer is charged.
If the customer has taken out the Flex rate including shuttle insurance (€9.99) when booking, the night surcharge does not apply at all. In this case the shuttle transfer between 00:00 and 03:00 is included at no additional cost.
7b.) Number of people in the shuttle
As a matter of principle, up to four (4) people for the shuttle transfer are included in the parking price booked. However, the number of people stated by the customer when booking is decisive for planning the service.
If fewer than four people are stated when booking and additional, unregistered people appear on the day of arrival, BD Parkraum GmbH is entitled to charge on site an organisation and processing fee amounting to €20.00 for these additional people, even if no more than four people are transported in total.
Customers are therefore advised to state the actual number of people travelling in full as early as the time of booking.
8.) Release of the vehicle
The vehicle is released to the customer or an authorised person only after the payment has been made. Payment can be made in cash or by debit card/credit card. Release to third parties only takes place on presentation of a power of attorney issued by the customer or the authorised person and of appropriate identification (identity card/passport).
9.) Liability of BD Parkraum GmbH, insurance cover
BD Parkraum GmbH is liable from the time the vehicle key is handed over by the customer until the vehicle is released (no. 6 of these terms and conditions) in accordance with the following provisions.
9a.) Handover in darkness, in the wet or with a soiled vehicle (WITH key handover)
Applies only if the vehicle is moved by the company
If the vehicle is handed over in darkness or with a rain-soaked, iced-up or heavily soiled body, the customer acknowledges that a complete visual inspection is not possible under these conditions. Subsequent complaints regarding paint, body or surface damage are excluded unless such damage is based on intentional or grossly negligent conduct on the part of BD Parkraum GmbH, its legal representatives or its vicarious agents.
Before handover, the customer is obliged to disclose particular vehicle characteristics, existing pre-damage or technical peculiarities that may affect the use, the manoeuvring or the storage of the vehicle. If the customer omits this information, any liability for damage resulting from it is excluded.
9b.) Handover in darkness, in the wet or with a soiled vehicle (WITHOUT key handover)
If the vehicle is handed over in darkness or with a rain-soaked, iced-up or heavily soiled body and the vehicle key is not handed over, a complete visual inspection by BD Parkraum GmbH is not possible. In this case the customer bears sole responsibility for paint, body or surface damage that is not recognised or not documented.
All subsequent complaints about such damage are excluded unless such damage is based on intentional or grossly negligent conduct on the part of BD Parkraum GmbH, its legal representatives or its vicarious agents.
The customer must also ensure that the vehicle is in a roadworthy and proper condition. No liability is accepted for damage resulting from pre-damage, technical peculiarities or an improper condition of the vehicle.
9c.) As a matter of principle, BD Parkraum GmbH is not liable for the loss of items from inside the vehicle or from the boot.
10.) Terms of payment
Payment is made when the vehicle is accepted by the customer or the legitimised second person, either in cash, net, or by credit card or debit card.
11.) Right to cancel any bookings and reservations
BD Parkraum GmbH reserves the right, following an overbooking, to place the vehicles in an adjacent car park and to park them there for the duration of the rental.
Likewise, the car park operator BD Parkraum GmbH may cancel reservations at any time; parking spaces that have already been paid for may also be cancelled by the provider BD Parkraum GmbH at any time.
Parking spaces with incorrect prices or allocated incorrectly can likewise be cancelled at any time.
The amounts paid are then refunded by BD Parkraum GmbH or by the third-party provider.
12.) Incorrect handover of the vehicle
If the vehicle is handed over to another provider although a booking confirmation from BD Parkraum GmbH exists, BD Parkraum GmbH accepts no liability for bringing the vehicle back or for any damage or financial loss incurred.
13.) Company premises / height restriction
The German road traffic regulations (Straßenverkehrsordnung) apply throughout the company premises.
Adapt to the traffic by driving at walking pace throughout the site.
The customer is fully liable for damage to car parks, pillars, fences, signs or other company property.
The height restriction at the entrance to the car park is a maximum of 2.00 m.
This height must be observed for every car without fail.
If the car does not fit into the car park because of its height, the parking price booked must be paid to BD Parkraum GmbH in full, even without travelling to the site and even without parking the car.
14.) Place of jurisdiction
The place of jurisdiction is the city of Hamburg, unless mandatory statutory provisions provide otherwise.
15.) Severability clause
Should individual provisions of this contract, including this provision, be or become wholly or partly invalid, the validity of the remaining clauses shall remain unaffected. The invalid provisions shall be replaced by the respective statutory provision that comes closest to the regulatory objective of the invalid clause.
